Terms of Service

These terms of service are put in place to ensure that M & D Web Host can provide quality service to all customers.

Content
All services provided by M & D Web Host may be used for lawful purposes only. Presentation, transmission, or storage, of any data, information, or material in violation with United States Federal, state, city, or local laws is strictly prohibited. The client agrees to hold M & D Web Host harmless from any claims of violation caused by the client. Examples of violations include but are not limited to:

• Pirated software
• Copyrighted material
• Hackers programs or archives
• Child pornography
• Warez sites

Server Resource Usage
To maintain uptime, reliability, and availability of all sites, the following limitations apply:

• Sites with a large amount of files being used by other domains are not allowed.
• Sites with large graphic or file archives/libraries are not allowed.
• Sites that use programs on the server which greatly affect the speed of the server are not allowed. This includes but is not limited to server based chat rooms, large indexing programs, and other server resource intensive programs.
• Sites in any way using an excessive amount of system resources as determined by M & D Web Host.
• M & D Web Host will be the sole judge as to what is a violation of these rules.

Background Programs
M & D Web Host does not allow the running of any programs that run in the background on the server.

Cron Jobs
M & D Web Host allows Cron Jobs to run as long as they do not conflict with the Server Resource Usage clause.

IRC
IRC bots are not allowed on our servers.

Idle Timeouts
M & D Web Host reserves the right to disconnect any idle connections to the server.

Emails
The sending of any unsolicited emails to any group of people is not allowed on our servers. M & D Web Host will be the judge as to what is a violation of this. Opt-in mailings are allowed, as long as there is a way for the recipient to be removed from the mailing. It is preferred that large mailings be sent in smaller groups and during the night when server load is lower.

Server Abuse
Any attempt to cause harm to M & D Web Host servers or web sites is strictly prohibited. Violators will be prosecuted.

Account Suspension/Termination
M & D Web Host reserves the right to suspend or terminate any account without notice. Repeated payment rejection or cancellation will result in account suspension. Accounts terminated for violating the terms of service will not receive any refund.

Privacy Policy
M & D Web Host respects the privacy of every visitor and client. We will make every attempt to make sure your personal information is kept secure. We will never give or sell your personal information to any third parties. We may store and use your information to better understand our customers or to contact them with questions about their account.

Modifications
M & D Web Host reserves the right to modify this terms of service as it sees fit. For any modifications seen as substantial by M & D Web Host all current clients will be notified.
